(2) To exercise your right to withdraw consent or to object, simply send an email to info@lohncomputer.ch. Withdrawal of consent and objections are free of charge.

§ 3
Purpose of collecting personal data when you visit our website

(1) If you use the website solely for information purposes, we collect only the personal data transmitted by your browser to our server. This information is stored temporarily in a log file. When you view our website, we collect the following data:

• IP address
• Date and time of the request
• Time zone difference from Coordinated Universal Time (UTC)
• Content of the request (specific page)
• Access status/HTTP status code
• Amount of data transferred in each case
• Website from which the request originates
• Browser
• Operating system and its interface
• Language and version of the browser software

(2) These data are collected to ensure a smooth connection and convenient use of the website, to evaluate system security and stability, and for other administrative purposes.

(3) The legal basis for collecting these data is Article 6(1), first subparagraph, point (f) GDPR.

Handling emails

(1) You may send us an email with any questions. We use your email address only for correspondence. You may voluntarily provide further information in your email. These data are processed to deal with your enquiry.

(2) The legal basis for collecting these data is your consent under Article 6(1), first subparagraph, point (a) GDPR.

(3) We delete the data arising in this context once storage is no longer necessary, or restrict processing if statutory retention obligations apply.

§ 5
Salary calculator

(1) You can use the salary calculator on our website. For this purpose, we ask for the following data:

• Gross monthly salary
• Age
• Gender
• Church membership
• Marital status
• Number of children
• Place of residence

These data are processed without a direct link to a specific individual (pseudonymised).

(2) Insofar as the information constitutes personal data at all, the legal basis for collecting it is Article 6(1), first subparagraph, point (a) GDPR.

§ 6
Requesting an offer

(1) To use our advisory services, you must provide the following personal details in a pop-up, modal or overlay window:

• Salutation
• Name
• Address
• Relocation status
• Telephone number
• Email address

(2) The legal basis for collecting these data is your consent under Article 6(1), first subparagraph, point (a) GDPR.

(3) We delete the data arising in this context once storage is no longer necessary, or restrict processing if statutory retention obligations apply. In any event, no later than after 12 months.

(4) We forward your data to the relevant advisers. Our advisers are based in Switzerland and Germany.

§ 7
Use of cookies

(1) Cookies are small amounts of data stored on your computer by the operator of a website. Data are stored in cookies to enable certain functions of our website.

(2) Temporary cookies are automatically deleted when you close your browser. They contain only an identification number (session ID) that allows the server to assign successive browser requests to the same user. Temporary cookies are used by many servers and do not pose a security risk.

(3) Permanent cookies, which can also be read by other servers, work differently. In the publicly accessible area of our website, we use only temporary cookies.

Analytics tools

(1) This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses cookies that enable analysis of website usage. The information generated by the cookie about users’ use of this website is generally transmitted to a Google server in the USA and stored there.

(2) If IP anonymisation is activated on this website, Google will first truncate your IP address within Member States of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On our behalf, Google will use this information to evaluate users’ use of the website, compile reports on website activity and provide other services relating to website usage and internet usage to the publisher.

(3) The IP address transmitted by your browser as part of Google Analytics will not be combined with other Google data. You can prevent cookies from being stored by adjusting your browser software settings; however, you may then be unable to use all the functions of this website in full. You can also prevent Google from collecting the data generated by the cookie relating to your use of the website (including your IP address) and from processing those data by downloading and installing the browser plug-in available at: tools.google.com/dlpage/gaoptout.

Our website also contains links to third-party websites, such as Facebook and Twitter. Please note that third-party privacy policies may contain provisions that differ from our privacy policy.

§ 10
Disclosure to third parties

(1) Your personal data will not be disclosed to third parties for purposes other than those listed below.

We disclose your personal data to third parties only if:

• You have given your express consent under Article 6(1), first subparagraph, point (a) GDPR;

• Disclosure is necessary for the establishment, exercise or defence of legal claims under Article 6(1), first subparagraph, point (f) GDPR and there is no reason to assume that you have an overriding legitimate interest in preventing disclosure of your data;

• Disclosure is required by a legal obligation under Article 6(1), first subparagraph, point (c) GDPR; or

• Disclosure is legally permissible and necessary for the performance of contractual relationships with you under Article 6(1), first subparagraph, point (b) GDPR.

(2) The data collected under § 6 are forwarded to our advisers listed on the website for career advice, health insurance and advice for cross-border commuters. Data are transferred only to third countries that ensure an adequate level of protection (for Switzerland: 2000/518/EC). If there is no adequacy decision, we obtain appropriate safeguards.

§ 11
Data security

(1) When you visit our website, we use the widely adopted SSL (Secure Socket Layer) protocol with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed key or padlock symbol in the lower status bar of your browser.

(2) We also use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction and unauthorised access by third parties. Our security measures are continually improved in line with technological developments.

§ 12
Contacting us via WhatsApp

The controller responsible for the processing described below is PORDEV GmbH, identified in § 1, as the operator of lohncomputer.ch.

(1) You may voluntarily contact us via WhatsApp. The service provider for users in the European region is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. Alternatively, you can contact us without using WhatsApp by emailing info@lohncomputer.ch.

(2) You can use the form on our website to prepare a message and then open WhatsApp. You send the message to us yourself in WhatsApp. To deal with your enquiry, we process your form entries, your WhatsApp telephone number, the message content and, where applicable, other profile and contact details you provide.

(3) Your details are processed and communication via WhatsApp takes place on the basis of your consent under Article 6(1)(a) GDPR. You may withdraw your consent at any time with effect for the future via WhatsApp or by emailing info@lohncomputer.ch. Withdrawal does not affect the lawfulness of processing carried out before you withdrew your consent. Following withdrawal, we will continue communicating through another channel if you wish.

(4) WhatsApp also processes account, usage, device and connection data in particular for its own purposes. Personal data are processed in the USA, among other countries. According to WhatsApp, its international data transfers rely in particular on adequacy decisions, including the EU–US and Swiss–US Data Privacy Framework, and on standard contractual clauses. Details about data processing and transfer safeguards are available in WhatsApp’s privacy policy.

(5) Your enquiry and contact details are forwarded to an advisory partner acting as an independent controller only with your separate consent. We inform you of the recipient and the purpose of disclosure before you give that consent. Consent to WhatsApp communication does not include consent to advertising.

(6) We delete the details and messages stored by us as soon as they are no longer needed to deal with your enquiry, unless statutory retention obligations or other legal grounds require or justify further storage. In that case, we restrict processing to the necessary purposes. WhatsApp’s own privacy policy also applies to storage by WhatsApp.

(7) Please do not send health data, such as diagnoses or medical reports, via the form or WhatsApp. If dealing with your enquiry requires such information, we will agree a suitable way of transmitting it with you.
